Attorney Client Privilege

All of your affairs handled with us are covered by attorney client privilege which means that we could not reveal anything about you or your affairs without your specific permission or unless we were ordered to do so by a Panama Court (not a common occurrence). If you buy an offshore corporation, offshore trust, offshore foundation or an offshore bank account from a non- law firm they could freely reveal your confidential information which they collect from you like name address, passport, name of corporation, bank account information etc. without any statutory penalties, in other words you do not have the benefit of attorney client privilege. Some of these corporate resale agents say they have some sort of financial privacy protections but it is flimsy and cursory at best. If so called privacy or confidentiality gets tested it is going to be tested by a judge who is a lawyer and whose privacy do you think the judge is going to be more likely to protect another lawyer or a corporate resale agent who is not a lawyer? Remember lawyers fight back and if other lawyers hear about any attorney client privileged communication piercing they are going to get involved actively since it can affect every other lawyer. A judge is not going to violate attorney client privilege without a lot of good cause to do so, in Panama think – money laundering, narcotics dealing, terrorism and child pornography. All tax violations in Panama are civil offenses, none are criminal and Panama has no tax treaties with any country. Panama actually requires all corporations formed to be formed by a lawyer to protect the privacy of their 400,000 corporations on file thus ensuring renewals each year. Panama cares about privacy, bank secrecy and asset protection.
Let’s say you use a non lawyer corporate agent in some offshore jurisdiction other than Panama since in Panama the corporate agent must be a lawyer. Now you have a problem with your bank there, or a government agency is requesting information from you, or the government there says your corporation owes taxes due to some filing error in the corporate papers, or you and/or your corporation get sued there. Now what are you going to do? Get on the internet and look for a lawyer. Now when you eventually talk to a lawyer after days of phone tag since off shore lawyers will normally not return overseas calls, the lawyer sees you are a foreigner and are in a rush or panic so do you think he is maybe going to inflate his charges to you thinking he just hit the offshore lottery? Do you think he will get in his car, drive over to your bank and have a meeting with the bank on your behalf for anything resembling a reasonable fee? What if you buy an off shore corporation or foundation from a lawyer, who sells corporations and foundations in 7 different jurisdictions, is he going to be able to help you? Well, you have a one in seven chance anyway. What if you buy from a corporate agent/reseller, who works with 7 jurisdictions, is he going to be able to help you? How could he, he is not a lawyer and he probably isn’t even located in the jurisdiction where he set you up. He can’t contact the bank on your behalf; he is not a lawyer let alone a lawyer in the correct jurisdiction where the corporation and bank are domiciled.
